Privacy Policy

This privacy policy defines the principles of storage, processing and access to information on the website and user devices used to provide services via electronic road.


Definitions

1. “Administrator” means a natural or legal person, public authority, institution or other entity that, alone or jointly with others, establishes the purposes and means of processing personal data.

2. “Official data” means any information about an identified or identifiable natural person (“data linked person”); an identifiable natural person is a person who can be directly or indirectly identified, in particular on the basis of an identifier such as a first and last name, an identification number, location data, an Internet identifier, or one or more special factors determining physical, physiological, genetic, mental, economic, cultural or social identi

3. “Processing” means an operation or set of operations performed on personal data or sets of personal data, whether automated or non-automated, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

4. “Third party” means a natural or legal person, public authority, public body, institution or other entity other than the person whose data are linked, the administrator, the processing subject or persons who – on behalf of the administrator or the processing subject – may process personal data.

5. “Consent” of the person whose data are linked means a voluntary, specific, informed and unambiguous expression of will by which the person whose data are linked, in the form of a statement or explicit action, confirms consent to the processing of his/her personal data.

6. “Personal data breach” means a security breach resulting in accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to personal data transmitted, stored or otherwise processed.

7. “Cookies” are information data, in particular small text files, recorded and stored on the devices with which the User uses the websites of the Service.

8. “Administrator Cookies” are cookies placed by the administrator related to the provision of e-road services by the administrator through the Service.

9. “External Cookies” are cookies placed by the administrator’s partners through the Service’s website.

10. “Service” means the website under which the administrator maintains a website operating in the domain www.biznesexpert.eu.

11. “Device” is the electronic device through which the User accesses the websites of the Service.

12. “User” is the entity on whom the E-Road Services may be provided or with whom an E-Road Services Agreement may be entered into in accordance with the Rules and the law.

Personal data administrator

2. Purpose of personal data processing:

1. Your personal data collected in the form will be processed in order to carry out legalization of stay on the territory of the Republic of Poland in accordance with the scope of data specified in Article 13 of the Act on Foreigners of 12 December 2013 (Dz.U. 2013 poz. 1650), the legal basis for the processing of your personal data is your consent – (Art. 6 para. 1 lit. a RODO).

2. Your personal data will be processed for the purpose of recruiting within the scope of the data administrator’s own vacancies, the legal basis for the data processing specified in the labor law and the Civil Code is the conclusion and execution of a contract – (Art. 6 para. 1 lit. b RODO).

3. Your personal data will be processed for employment purposes within the framework of the data controller’s own recruitment procedures (the legal basis is Art. 22(1) of the Labor Code and Art. 734 of the Civil Code).

4. Your personal data will be processed for the purpose of exercising your rights (the legal basis for processing is the legitimate interest of the administrator – Art. 6 para. 1 lit. f RODO).

5. Your personal data will be processed for the purpose of sending marketing materials, the legal basis for processing your data is your consent – (Art. 6 para. 1 lit. a RODO).

6. If you have consented to the processing of your personal data in the form of Cookies for personalization, remembering preferences and settings such as login and password, IP address, login date and time. The basis for processing will be Article 173, Telecommunications Law. Your personal data will be stored until consent is withdrawn.

7. Your personal data will be provided to third parties for the provision of services in support of Biznes Expert, including: accounting, legal, solicitation, IT services, whereby the mentioned parties will process your personal data on the basis of concluded contracts and exclusively upon your documented request.

8. In addition to the aforementioned subjects, your personal data may only be transferred at the request of authorized subjects in accordance with the law.

9. The above-mentioned consents may be withdrawn at any time by sending an application to the office address: ul. Gdańska 89/1, Bydgoszcz 85-022, KRS 0000986528, NIP 9671458021, REGON 522786930, by Polish Post or by e-mail to biuro@biznesexpert.eu.

10. Withdrawal of consent does not affect the lawfulness of the processing carried out prior to its withdrawal.

11. You have the right to request the administrator to access, rectify, delete, data portability or restrict processing of your personal data, as well as the right to withdraw consent to processing to the extent that processing has been or is being carried out on the basis of your consent, and the right to object to processing.

12. You have the right to file a complaint with the General Directorate for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw.

Types of cookies used

1. The cookies used by the administrator are safe for the user’s device. In particular, viruses or other unwanted or malicious software cannot be transmitted to users’ devices through them. These files make it possible to identify the software used by the user and to configure the Service individually for each user according to the contract. Cookies usually contain the name of the domain from which they originate, the time they are stored on the device, and an assigned value.

2. the Administrator uses two types of cookies:

1. Session cookies: these are stored on the user’s device and remain there until the browser session ends. The recorded information is then permanently deleted from the memory of the device. The session cookie mechanism does not allow any personal data or sensitive information to be collected from a user’s device;

2. Persistent cookies: these are stored on the user’s device and remain there until deleted. Ending a browser session or turning off the device does not remove them from the user’s device. The persistent cookies mechanism does not allow any personal data or sensitive information to be retrieved from the user’s device.

3. The user has the ability to restrict or disable access to cookies on their device. If this option is used, use of the Service will be possible, except for features that by their nature require cookies.

Purposes for which Cookies are Used

The administrator uses its own cookies for the correct configuration of the service, in particular for:

• adapting the content of the Service web pages to the User’s preferences and optimizing the use of the Service web pages;

• detecting the Service User’s device and location, and displaying the web page accordingly, adapted to their individual needs;

• remembering the settings selected by the User and personalizing the User interface, such as setting the selected language or the region from which the User originates;

• remembering the history of visited pages on the site for content recommendation;

• font size, appearance of the web page, etc.

The Administrator uses its own cookies to authenticate the user to the service and to ensure the user’s session on the service, in particular to:

• maintaining the Service User’s session (after login), so that the User does not have to re-enter the login and password on each sub-page of the Service;

• proper configuration of selected features of the Service, including browser session authentication features;

• optimize and improve the performance of the services provided by the Administrator.

The Administrator uses its own cookies to carry out processes necessary for the full functionality of the web pages, in particular for:

• adapting the content of the Service web pages to the User’s preferences and optimizing the use of the Service web pages. In particular, these files make it possible to recognize the basic parameters of the user’s device and display a web page accordingly, adapted to the user’s individual needs;

• proper operation of the affiliate program, including the specifics of checking the sources of redirecting users to the Service web pages.

The Administrator uses its own cookies to remember the user’s location, in particular for the correct configuration of the selected features of the Service, allowing the information provided to the user to be adapted to his or her location.

The Administrator uses its own cookies to analyze, research and audit browsing, in particular to create anonymous statistics that help to understand how users of the Service use the Service’s web pages, allowing it to improve their structure and content.

Possibilities to define storage conditions or access through cookies

• The user can independently and at any time change the settings relating to cookies, determining the conditions for storing and accessing cookies on the user’s device. The user can make changes to the settings referred to in the previous sentence using web browser settings or service configuration. These settings can be changed, in particular in such a way as to block the automatic processing of cookies in the web browser settings or to notify you whenever cookies are placed on the user’s device. Detailed information about the options and how cookies are handled is available in the software (web browser) settings.

• The user can delete cookies at any time using the available functions of the web browser they are using.

• Restricting the use of cookies may affect some of the functionality available on the Service’s website.
